Pagerless is a SaaS platform designed to manage restaurant orders and notify customers when their order is ready for pickup via digital notifications, including push notifications and Facebook Messenger. Our goal is to streamline restaurant operations and improve customer experiences.

3. Accounts and Access

• Registration: To access the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Eligibility: You must be at least 18 years old to use the Service. By using Pagerless, you represent and warrant that you meet this eligibility requirement.
• Termination: We reserve the right to suspend or terminate your account at any time for violating these Terms or for any other reason deemed necessary to maintain the integrity of the Service.

4. Pricing and Payment

• Subscription Plans: We offer different subscription plans for restaurants of various sizes. Pricing details are available on our website. By signing up for a paid plan, you agree to pay the applicable subscription fees.
• Billing Cycle: Subscriptions are billed on a monthly or annual basis, depending on your selected plan. Payments are non-refundable, except as required by law or at our discretion.
• Changes to Pricing: We reserve the right to change subscription prices at any time. If a price change occurs, you will be notified in advance and given the opportunity to adjust your plan or cancel the Service.

5. Use of the Service

• License: Subject to your compliance with these Terms, Pagerless grants you a limited, non-exclusive, non-transferable license to use the Service for your restaurant’s operations.
• Restrictions: You agree not to:

• Modify, adapt, reverse-engineer, or decompile the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Share login credentials with unauthorized users.

6. Customer Notifications
Pagerless allows you to notify your customers via mobile push notifications, SMS, or Facebook Messenger. By using these features, you represent that you have obtained all necessary consents from customers to send them notifications.

7. Data Privacy
Your use of the Service is subject to our Privacy Policy, which outlines how we collect, store, and process personal data in compliance with GDPR and other applicable privacy regulations. You agree to obtain appropriate customer consent for any data you collect or share through our platform.

8. Third-Party Services
The Service may integrate with third-party services, such as Facebook Messenger. You acknowledge and agree that Pagerless is not responsible for the actions or policies of third-party services. Use of third-party services is subject to their respective terms and privacy policies.

9. Intellectual Property

• Ownership: All intellectual property rights in the Service, including trademarks, logos, software, and content, belong to Pagerless or its licensors. Nothing in these Terms grants you any ownership rights in the Service.
• User Content: Any content you submit to the Service, including customer information or order details, remains your property. You grant Pagerless a limited, non-exclusive license to use this content solely for the purpose of providing the Service.

10. Limitation of Liability

• No Warranties: Pagerless is provided “as-is” and “as available.” We do not guarantee that the Service will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied.
• Limitation of Damages: In no event shall Pagerless be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service, including loss of data, revenue, or business opportunity, even if we have been advised of the possibility of such damages.
• Maximum Liability: Our total liability to you for any claims arising out of or related to your use of the Service will not exceed the amount you paid to us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Pagerless, its affiliates, and their respective officers, employees, and agents from and against any claims, damages, liabilities, losses, or expenses arising out of your use of the Service, violation of these Terms, or violation of any rights of third parties.
